By accessing or using ajwebservices.com or any services offered by A & J Web Services (“Company,” “we,” “us,” or “our”), you acknowledge that you have read, understood, and agree to be bound by the terms of this Privacy Policy and Terms of Use in their entirety. If you do not agree, you must immediately discontinue use of this website and all associated services.

1. Who We Are and Scope of This Policy

A & J Web Services is a digital marketing agency operating under the laws of the State of Arizona, United States. Our primary business address is in the Phoenix metropolitan area. We operate the website located at ajwebservices.com (the “Site”) and provide digital marketing services, social media management, advertising campaign management, content creation, email and SMS marketing, and related software tools including the A & J Lead Scraper (collectively, the “Services”).

This Privacy Policy and Terms of Use (“Policy”) governs all information collected, processed, stored, or transmitted in connection with your use of the Site or Services, regardless of how you access them — including via desktop, mobile device, application, or any other medium. This Policy applies to all visitors, users, clients, subscribers, and any other individual or entity that interacts with the Site or Services in any capacity.

This Policy does not apply to third-party websites, applications, or services that may be linked to or from our Site. We are not responsible for the privacy practices of any third party, and we encourage you to read the privacy policies of every website you visit.

2. Information We Collect

2.1 Information You Provide Directly

We collect information that you voluntarily provide to us when you interact with the Site or Services. This includes, but is not limited to:

  • Full name, business name, email address, phone number, and any other contact details submitted through our contact form, inquiry form, or SEO audit request form
  • Communications you send to us via email, contact forms, or any other channel
  • Account credentials and portal passwords if you are a client accessing our Client Portal
  • Business information, marketing assets, social media account credentials, and other materials shared with us in the course of receiving our Services
  • Billing information and payment details processed through our third-party payment processor, Stripe (note: we do not directly collect or store full payment card numbers — see Section 6)
  • Subscription information related to the A & J Lead Scraper software product

2.2 Information Collected Automatically

When you visit the Site, certain information is collected automatically through your browser and device. This may include:

  • IP address and approximate geographic location derived therefrom
  • Browser type, version, and settings
  • Operating system and device type
  • Pages visited, time spent on pages, and navigation paths through the Site
  • Referring URLs and exit pages
  • Date and time of your visit
  • Aggregate traffic and usage statistics collected through Cloudflare Web Analytics (see Section 7)

2.3 Information from Third Parties

We may receive information about you from third-party sources, including but not limited to payment processors, advertising platforms, and analytics providers. We may combine this information with data we collect directly from you.

3. How We Collect Information

We collect information through the following means:

  • Contact and inquiry forms — processed and delivered via Formspree, a third-party form handling service
  • Payment processing — handled exclusively by Stripe, Inc., a PCI-DSS-compliant payment processor
  • Website analytics — collected via Cloudflare Web Analytics, a privacy-focused, cookie-free analytics platform, and Google Analytics (see Section 7)
  • Direct email and phone communications — when you contact us via email at info@ajwebservices.com or through our booking calendar
  • Client onboarding — information shared during the onboarding process, including account credentials and business assets
  • Cookies and local storage — limited use for portal authentication and user preferences (see Section 7)

4. How We Use Your Information

We use the information we collect for the following purposes:

  • To respond to inquiries, contact form submissions, and service requests
  • To provide, deliver, manage, and improve our digital marketing Services
  • To process payments and manage billing for our Services and software subscriptions
  • To communicate with you regarding your account, subscription, campaigns, and service updates
  • To send you operational emails related to your engagement with our Services, including onboarding materials, campaign reports, and account notifications
  • To fulfill our contractual obligations to you as a client under any signed service agreement
  • To conduct internal analytics, improve the performance of the Site, and develop new features or services
  • To comply with applicable laws, regulations, and legal obligations
  • To enforce our agreements, policies, and terms
  • To protect the rights, property, and safety of A & J Web Services, our clients, and the public
  • To send you marketing communications about our Services where we have a lawful basis to do so

We will not use your information for purposes incompatible with those described above without your prior consent, except as required by law.

5. How We Share and Disclose Information

We do not sell, rent, trade, or otherwise transfer your personal information to third parties for their own marketing or commercial purposes. We may share your information in the following limited circumstances:

5.1 Service Providers and Processors

We share information with trusted third-party vendors and service providers who assist us in operating the Site and providing the Services. These parties are contractually obligated to process your information only as directed by us and in accordance with applicable privacy law. See Section 6 for a full list of current third-party processors.

5.2 Legal Requirements and Protection of Rights

We may disclose your information if required to do so by law, court order, subpoena, or other governmental or regulatory authority. We may also disclose information when we believe in good faith that such disclosure is necessary to:

  • Comply with applicable law or legal process
  • Protect the rights, property, or safety of A & J Web Services, our clients, employees, or the public
  • Detect, prevent, or address fraud, security, or technical issues
  • Enforce our agreements, policies, and terms

5.3 Business Transfers

In the event that A & J Web Services is involved in a merger, acquisition, asset sale, reorganization, bankruptcy, or other business transaction, your information may be transferred as part of that transaction. We will notify you of any such change via email or prominent notice on the Site prior to your information being transferred and becoming subject to a different privacy policy.

5.4 With Your Consent

We may share your information with third parties in ways not described above when we have your explicit consent to do so.

6. Third-Party Services and Processors

We currently use the following third-party services in connection with the Site and Services. Each operates under its own privacy policy, and we encourage you to review those policies independently:

6.1 Formspree

We use Formspree (formspree.io) to receive and deliver contact form submissions from the Site. When you submit a contact form, your name, email address, business name, and message are transmitted to Formspree's servers and forwarded to our email inbox. Formspree's privacy policy is available at formspree.io/legal/privacy-policy. A & J Web Services is not responsible for the privacy or security practices of Formspree.

6.2 Stripe, Inc.

Payment processing for the A & J Lead Scraper subscription and any other paid services is handled exclusively by Stripe, Inc. (stripe.com). When you complete a purchase or subscription, you are submitting your payment information directly to Stripe's secure hosted checkout environment. A & J Web Services does not receive, store, process, or have access to your full credit card number, CVV, or other sensitive payment card data at any point. Stripe is a PCI-DSS Level 1 certified payment processor. Stripe's privacy policy is available at stripe.com/privacy. By completing a purchase, you also agree to Stripe's terms of service.

6.3 Cloudflare Web Analytics

We use Cloudflare Web Analytics to collect aggregate, anonymized data about how visitors interact with the Site. Cloudflare Web Analytics does not use cookies, does not track individual users across sessions or websites, and does not build behavioral profiles. The data collected is limited to aggregate metrics such as page view counts, approximate geographic regions, and referral sources. Cloudflare's privacy policy is available at cloudflare.com/privacypolicy.

6.4 Google Services

Our business email (info@ajwebservices.com) is operated through Google Workspace. Email communications you send to us are transmitted through and stored on Google's servers and are subject to Google's privacy policy at policies.google.com/privacy. We also use Google Calendar (via Google Calendar App) for appointment booking. When you book an appointment, your name and email address are shared with Google's calendar infrastructure.

6.5 Netlify

This website is hosted on Netlify, a static site hosting service provided by Netlify, Inc. Netlify may collect certain technical information related to requests made to its servers, including IP addresses and request logs, as part of its standard hosting operations. Netlify's privacy policy is available at netlify.com/privacy.

We reserve the right to add, remove, or replace third-party service providers at any time. Material changes to our use of third-party processors will be reflected in updates to this Policy.

7. Cookies, Tracking, and Analytics

7.1 Our Direct Use of Cookies

The A & J Web Services website does not use first-party cookies for advertising or behavioral profiling purposes, other than the Google Analytics cookies described in Section 7.4. We use browser localStorage and sessionStorage in limited circumstances for functional purposes, including:

  • Remembering your preference to dismiss the promotional banner on the Site (stored locally in your browser, never transmitted to our servers)
  • Maintaining your authenticated session in the Client Portal (stored in sessionStorage for the duration of your browser session only)

7.2 Third-Party Cookies

When you complete a purchase through Stripe's hosted checkout page, Stripe may set cookies on your device for fraud prevention, security, and payment processing purposes. These cookies are governed by Stripe's own cookie policy. We do not control the cookies set by Stripe or any other third-party service.

7.3 Do Not Track

Some browsers transmit Do Not Track (DNT) signals to websites. Because there is no industry standard for how websites should respond to DNT signals, we do not currently alter our practices in response to DNT signals. We will continue to monitor developments in this area.

7.4 Analytics

As described in Section 6.3, we use Cloudflare Web Analytics for privacy-preserving site analytics. This service does not use cookies and does not enable individual user tracking.

We also use Google Analytics, a web analytics service provided by Google LLC, to collect data about how visitors use the Site — such as pages visited, time on site, approximate location, and referral source. Google Analytics sets cookies on your device to distinguish visitors and measure usage, and this data is shared with Google and processed in accordance with Google's privacy policy, available at policies.google.com/privacy. You can opt out of Google Analytics by installing Google's opt-out browser add-on, available at tools.google.com/dlpage/gaoptout.

8. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, to comply with our legal obligations, resolve disputes, and enforce our agreements. The specific retention period for any given category of information depends on the nature of that information and the purpose for which it is used.

In general:

  • Contact form submissions are retained in our email inbox for as long as the underlying business relationship or inquiry warrants, typically no longer than three (3) years
  • Client account information and service records are retained for the duration of the client relationship and for a period of seven (7) years thereafter to comply with applicable tax, accounting, and legal requirements
  • Payment records and transaction data are retained by Stripe in accordance with Stripe's data retention policies and applicable financial regulations; we retain copies of transaction summaries for our own accounting purposes
  • Analytics data collected through Cloudflare is aggregate and anonymized; it does not identify individual users and is retained per Cloudflare's standard practices

When information is no longer needed, we take reasonable steps to destroy, delete, or de-identify it in a secure manner. However, we cannot guarantee that residual copies of deleted information will not persist in backup systems, archived records, or third-party systems outside our direct control.

9. Data Security and Limitation of Liability

9.1 Security Measures

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect the information we collect from unauthorized access, disclosure, alteration, destruction, and misuse. These measures include the use of HTTPS encryption for data transmitted to and from the Site, access controls limiting who within our organization may access personal information, reliance on PCI-DSS-compliant third-party processors for payment handling, and regular review of our data practices.

9.2 No Guarantee of Security

IMPORTANT: No method of transmission over the internet and no method of electronic storage is completely secure. Despite our efforts, we cannot guarantee the absolute security of any information you transmit to us or that we store on your behalf. Any transmission of personal information is at your own risk.

A & J Web Services expressly disclaims any and all liability for:

  • Any unauthorized access to, acquisition of, disclosure of, or use of your personal information resulting from a data breach, cyberattack, hacking incident, phishing attack, malware, ransomware, or any other security incident beyond our reasonable control
  • Any breach, compromise, or unauthorized access occurring at or through any third-party service provider, including but not limited to Formspree, Stripe, Cloudflare, Google, or Netlify
  • Any loss, theft, corruption, or unauthorized alteration of your personal information resulting from circumstances outside our reasonable control, including but not limited to acts of third parties, software vulnerabilities in systems we do not own or operate, or force majeure events
  • Any consequential, incidental, indirect, special, or punitive damages of any kind arising out of or in connection with any actual or alleged data breach, unauthorized access, or security incident, regardless of whether we have been advised of the possibility of such damages
  • Any damages, losses, costs, or liabilities (including legal fees) arising from your reliance on the security of third-party payment processors, form services, hosting providers, or analytics platforms used in connection with this Site

9.3 Your Responsibilities

You are responsible for maintaining the confidentiality of any credentials, passwords, or access information you use to access our Client Portal or any other protected area of the Site. You agree to notify us immediately at info@ajwebservices.com if you believe your account has been compromised or if you become aware of any unauthorized use of your credentials. We are not liable for any loss or damage arising from your failure to maintain the security of your login credentials or from unauthorized use of your account.

9.4 Aggregate Liability Cap

To the maximum extent permitted by applicable law, A & J Web Services' total aggregate liability to you arising out of or in connection with this Policy, the Site, or the Services — including in connection with any data security incident — shall not exceed the greater of (a) the total amount paid by you to A & J Web Services in the three (3) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100.00).

10. Children's Privacy

The Site and Services are not directed to, and are not intended for use by, individuals under the age of 18. We do not knowingly collect, solicit, or maintain personal information from anyone under the age of 18. If we learn that we have inadvertently collected personal information from a person under 18, we will take prompt steps to delete that information from our systems.

If you are a parent or guardian and believe that your child under the age of 18 has provided personal information to us without your consent, please contact us immediately at info@ajwebservices.com so that we can take appropriate action.

11. Your Rights and Choices

Subject to applicable law and certain exceptions, you may have the following rights with respect to your personal information:

  • Access: You may request a copy of the personal information we hold about you.
  • Correction: You may request that we correct inaccurate or incomplete personal information we hold about you.
  • Deletion: You may request that we delete your personal information, subject to certain exceptions required by law or legitimate business necessity.
  • Restriction: You may request that we restrict our processing of your personal information in certain circumstances.
  • Objection: You may object to certain types of processing of your personal information, including processing for direct marketing purposes.
  • Data Portability: Where technically feasible, you may request that we provide your personal information in a structured, machine-readable format.
  • Withdrawal of Consent: Where processing is based on your consent, you may withdraw that consent at any time without affecting the lawfulness of processing carried out prior to withdrawal.

To exercise any of these rights, please submit a written request to info@ajwebservices.com with the subject line “Privacy Rights Request.” We will respond to your request within a reasonable timeframe and in accordance with applicable law. We may require verification of your identity before processing your request. We reserve the right to deny requests that are frivolous, vexatious, impractical, or contrary to our legal obligations.

Please note that exercising certain rights may affect our ability to provide Services to you. Deletion of information necessary to fulfill a service agreement, for example, may result in the termination of that agreement.

12. California Residents — Additional Rights

If you are a resident of California, you may have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), and under California Online Privacy Protection Act (CalOPPA).

12.1 Categories of Personal Information Collected

In the preceding twelve (12) months, we have collected the following categories of personal information from California consumers: identifiers (such as name and email address); commercial information (such as subscription records); internet or other electronic network activity information (such as aggregate browsing data); and professional or employment-related information (such as business name and industry).

12.2 Sale or Sharing of Personal Information

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising purposes. Accordingly, we do not offer an opt-out of sale or sharing, as those activities do not occur.

12.3 Non-Discrimination

We will not discriminate against you for exercising any of your rights under the CCPA or CPRA. We will not deny you services, charge you different prices, or provide a different quality of service as a result of your exercise of these rights.

12.4 Authorized Agent

California residents may designate an authorized agent to submit privacy rights requests on their behalf. We may require verification of the agent's authority and confirmation of your identity before processing such requests.

12.5 CalOPPA Disclosure

In accordance with CalOPPA, we disclose that this Site does not respond to Do Not Track signals from browsers. We do not permit third parties to collect personally identifiable information about your online activities over time and across different websites when you use our Site, except as described in this Policy.

13. International Users

This Site is operated from the United States and is primarily intended for users located within the United States. If you are accessing the Site from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country of residence.

By using the Site or Services from outside the United States, you consent to the transfer, processing, and storage of your information in the United States in accordance with this Policy. If you are located in the European Economic Area, United Kingdom, or Switzerland, please note that the legal basis for our processing of your personal information includes your consent, the performance of a contract with you, and our legitimate interests in operating and improving our business.

We make no representation that the Site or Services are appropriate or available for use in all jurisdictions. Users who access the Site from jurisdictions outside the United States do so on their own initiative and are responsible for compliance with applicable local laws. A & J Web Services expressly disclaims any liability arising from your use of the Site or Services in jurisdictions where such use may be restricted or prohibited.

14. Disclaimer of Warranties

THE SITE AND ALL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, A & J WEB SERVICES EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, reliability, or suitability of any information on the Site. You assume sole responsibility for your use of the Site and Services and any decisions you make based on information obtained from them.

We are not responsible or liable for any content, code, or other materials provided by third parties. Reference to any third-party products, services, websites, or other information does not constitute or imply endorsement, sponsorship, or recommendation by A & J Web Services.

15. Indemnification

You agree to indemnify, defend, and hold harmless A & J Web Services and its owners, officers, employees, agents, contractors, and representatives from and against any and all claims, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of or inability to use the Site or Services
  • Your violation of this Policy or any applicable law or regulation
  • Your violation of any rights of any third party
  • Any information you provide to us that is inaccurate, incomplete, or misleading
  • Your breach of any agreement entered into with A & J Web Services
  • Any unauthorized use of your account credentials by any person

We reserve the right, at our own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of that claim.

16. Governing Law and Dispute Resolution

This Policy and any disputes arising out of or related to it shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to this Policy shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you hereby consent to the personal jurisdiction and venue of such courts.

Before initiating any formal legal proceeding, you agree to first contact us at info@ajwebservices.com and attempt to resolve any dispute informally through good-faith negotiation. If a resolution cannot be reached within thirty (30) days of written notice, either party may pursue formal legal remedies.

Notwithstanding the foregoing, you agree that A & J Web Services shall have the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property, confidential information, or other proprietary rights without the requirement of posting a bond or other security.

16.1 Binding Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court. Except as set out below, any dispute, claim, or controversy arising out of or relating to your use of the Site, our Services, or this Policy, including the existence, validity, interpretation, breach, or termination of any agreement between us, shall be resolved exclusively through final and binding arbitration rather than in court.

The arbitration shall be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and, where applicable, its Consumer Arbitration Rules. The arbitration shall take place in Maricopa County, Arizona, and shall be governed by the laws of the State of Arizona, without regard to its conflict of law principles. The arbitrator’s decision shall be final, and judgment on the award may be entered in any court of competent jurisdiction.

16.2 Class Action Waiver

You and A & J Web Services agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of representative or class proceeding.

16.3 Jury Trial Waiver

You and A & J Web Services waive any right to a trial by jury in any matter arising out of or relating to this Policy or your use of the Site or Services.

16.4 Exceptions

Either party may bring an individual claim in small claims court for any dispute within that court’s jurisdiction. In addition, and consistent with the injunctive-relief provision above in this Section 16, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property, confidential information, or other proprietary rights.

16.5 Thirty-Day Right to Opt Out

You may opt out of this arbitration agreement and the class action waiver within thirty (30) days of the date you first accept it by sending written notice to info@ajwebservices.com that includes your name and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of this Policy.

16.6 Severability of This Section

If the Class Action Waiver in Section 16.2 is found to be unenforceable, then the entirety of this arbitration agreement (Sections 16.1 through 16.6) shall be null and void, but the remainder of this Policy shall remain in full force and effect. If any other provision of this arbitration agreement is found to be unenforceable, that provision shall be severed and the remainder of this arbitration agreement shall continue to apply.

17. Changes to This Policy

We reserve the right to update, modify, or replace this Policy at any time and for any reason, at our sole discretion. When we make changes, we will update the “Last Updated” date at the top of this page. In the case of material changes, we may also notify you by email (if you have provided one) or by posting a prominent notice on the Site.

Your continued use of the Site or Services following the posting of any changes constitutes your acceptance of the updated Policy. If you do not agree to the revised Policy, you must immediately cease using the Site and Services and, if applicable, cancel any active subscriptions.

We encourage you to review this Policy periodically to stay informed about how we are protecting your information. It is your responsibility to check for updates.
